Terms and Conditions

Effective Date and Acceptance

These Terms and Conditions govern your use of Diabetic Supply Rescue and our mail-in supply review and purchase service. By using our website, requesting a mail-in kit, sending items to us, or accepting payment from us, you agree to these Terms and Conditions.

Eligibility

You must be at least 18 years old and a resident of the United States to use our service. By using the service, you represent that you meet these requirements and have the legal right to submit the items you send to us.

Service Description

You may request a free mail-in kit, pack and send items according to our instructions, and receive an inspection after we receive the shipment. If we accept your items, we calculate a payout and send payment using an available payment method.

Eligible and Prohibited Items

Eligible items may include unopened, unexpired diabetic supplies that we currently accept and that meet our condition, safety, and compliance requirements.

Prohibited items include expired items, opened or used CGM sensors, tampered items, fraudulent or counterfeit items, stolen or misrepresented items, items submitted by an unauthorized reseller, recalled items, and items that are unsafe, contaminated, damaged, improperly stored, or otherwise non-compliant.

Payout Calculation, Methods, and Timing

Payout amounts are calculated after inspection and may depend on item type, brand, model, quantity, expiration date, packaging condition, current demand, and whether the items meet our acceptance standards.

Quoted or estimated amounts are not final until we inspect and accept the items. Available payment methods may include check, PayPal, Zelle, or Venmo. Payment timing may vary based on inspection, verification, payment method, holidays, weekends, payment processor delays, and other operational factors.

Right to Refuse and Dispose

We reserve the right to refuse any item for any reason, including if we determine that an item is unsafe, prohibited, non-compliant, fraudulent, recalled, tampered with, or otherwise unacceptable. We may dispose of unsafe, prohibited, or non-compliant items at our discretion and are not required to return those items or provide payment for them.

Shipping Risk and Title Passage

You are responsible for packing items securely and following all shipping instructions. Risk of loss or damage remains with you until we receive the shipment. Title to accepted items passes to Diabetic Supply Rescue only after we inspect and accept the items and issue payment.

Warranty Disclaimer

The website and service are provided on an as-is and as-available basis. Diabetic Supply Rescue disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Limitation of Liability

To the fullest extent permitted by law, Diabetic Supply Rescue will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or loss of goodwill. Our total liability for any claim related to the service will not exceed the amount we actually paid you for the items at issue.

Indemnification

You agree to indemnify, defend, and hold harmless Diabetic Supply Rescue and its owners, employees, contractors, agents, and affiliates from claims, liabilities, damages, losses, costs, and expenses arising from your use of the service, your submitted items, your breach of these Terms and Conditions, or your violation of any law or third-party right.

Binding Arbitration, Small Claims, and Class Action Waiver

You and Diabetic Supply Rescue agree that any dispute, claim, or controversy arising out of or relating to these Terms and Conditions, the website, the service, submitted items, inspection, rejection, disposal, or payment will be resolved by binding individual arbitration, except that either party may bring a qualifying claim in small claims court.

Arbitration will take place on an individual basis only. You and Diabetic Supply Rescue waive any right to bring or participate in a class action, collective action, private attorney general action, or other representative proceeding.

Governing Law and Venue

These Terms and Conditions are governed by applicable law, without regard to conflict of law rules that would require use of another jurisdiction's law. For any claim that is not subject to arbitration and cannot be brought in small claims court, venue will be determined by applicable law and any confirmed business operating location. Nothing in this section limits rights that cannot be waived by contract.

Modifications

We may update or modify these Terms and Conditions at any time. The updated version will be effective when posted unless a different effective date is stated.

Severability and Entire Agreement

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. These Terms and Conditions are the entire agreement between you and Diabetic Supply Rescue regarding the website and service.
